Queensland's Constitution: Past, Present and Future

The Supreme Court of Queensland Library is pleased to present 'Queensland's Constitution: Past, Present and Future'. This collection has been edited, with two added chapters, from the papers which leading judges, academics and practitioners gave at the 'Queensland Constitution: Origins and Evolution' conference in the historic Legislative Council Chamber of Queensland Parliament House on Friday 29 May 2009.

This Q150 conference was hosted by the Supreme Court of Queensland Library and the Centre for Public, International and Comparative Law of the TC Beirne School of Law in The University of Queensland as a scholarly contribution to the celebration of the sesquicentenary of the erection of the new Colony of Queensland from New South Wales on 10 December 1859.

BAILII: British and Irish Legal Information Institute

The UK equivalent to AUSTLII, practitioners and the general public can use BAILII to search for or access British and Irish case law & legislation, European Union case law, Law Commission reports, and other law-related British and Irish material. BAILII is a freely available internet database that provides access to the most comprehensive set of British and Irish primary legal materials that are available for free and in one place on the internet.

Weblaw is a free online collection of online Australian and International legal databases and resources. The resources are cataloged according to subject area and has been complied by law libraries across Australia.
The aim of WebLaw is to enhance research and learning in all areas of Australian law. The website utilises the combined experience of law librarians, legal information experts, and the infrastructure of the participating institutions to provide comprehensive coverage of as many areas of Australian law as possible. Areas of law covered include Administrative, Constitutional, Family, E-Commerce, Property and Taxation Law and resources include links to relevant legislation, courts and tribunals, organisations, journals and publications.

The Oxford International Encyclopedia of Legal History (Online Reference)

The Oxford International Encyclopedia of Legal History, edited by Stanley N. Katz, is the first encyclopedia of law to provide both historical and contemporary comparisons of the world legal systems. The Oxford International Encyclopedia of Legal History covers legal history from ancient to modern times. Major categories of law explained in detail include private law (contract, tort, civil procedure), public law (statutory, criminal, etc.), and higher or constitutional law. This useful resource is available online through the Supreme Court library website.

The Global Legal Information Network (GLIN) is a public database of official texts of laws, regulations, judicial decisions, and other complementary legal sources contributed by governmental agencies and international organizations. These GLIN members contribute the full texts of their published documents to the database in their original languages. Each document is accompanied by a summary in English. All summaries are available to the public, and public access to full texts is also available for some jurisdictions.

Family Law Council (Australia)

Publications home page of the Family Law Council which is a statutory authority established under section 115 of the Family Law Act 1975. It commenced operation in November 1976. The Council meets quarterly around Australia. It provides advice to the Attorney-General in two forms: first, letters of advice on matters requiring urgent advice or on issues where the Attorney requires a quick and representative viewpoint; and second, reports on major issues. Online Resource: ASIC online insolvency portal

The portal provides information specific to each stakeholder group about their rights and obligations and responds to frequently asked questions. It also assists stakeholders to understand the technical jargon of insolvency and outlines the most common forms of corporate insolvency administration. In addition to company directors, the website provides links for company creditors (for example, suppliers) and for employees to assist them in identifying possible signs of insolvency in companies with which they are involved. For the first time, the website also includes new information for shareholders and investors who either own shares in, or have invested through, failed companies. For insolvency practitioners, the portal includes existing website information about their registration and compliance obligations.

Focusing on the use of online legal databases, sessions will be presented by specialist trainers from the leading legal publishers. Australian Taxation Law Library

The Australian Taxation Law Library provides in one searchable location all of the tax-related resources on AustLII, including legislation, case law, legal scholarship and treaties. In addition, the Library makes it possible to search a wide range of other tax resources at the same time by choosing from three other search options: Law on Google, Catalog and Websearch, and the ATO Legal Database. The Library also includes a test application of AustLII’s Point-in Time technology to the Fringe Benefits Tax Assessment Act 1986 (Cth), allowing users to easily find a section of the Act as it was at a particular date, and to compare a section at different dates.

New Subscription: Queensland Building Service

Thomson’s Queensland Building Service is a comprehensive resource on building law and regulation in Queensland. The service includes the full text and annotations to the Building and Construction Industry Payments Act 2004, the Queensland Building Services Authority Act 1991, the Commercial and Consumer Tribunal Act 2003, and the Domestic Building Contracts Act 2000. It also includes the full text and annotations to the Building Code of Australia and the Queensland Development Code.

New Exhibition: The Supreme Court Fire 1968

An exhibition commemorating the 40th anniversary of the Supreme Court Fire 1968 is currently on display on level 2 of the Supreme Court. The exhibition examines the fire that burnt down the original courthouse, the police investigation and subsequent trial of the arsonist, as well as the temporary arrangements that allowed the work of the courts to continue. It also features a history of Brisbane court buildings from 1879-2011, including a sneak peek at the new Supreme Court due for completion in 2011.

Virtually Everywhere

The new Supreme Court Library website is now live, featuring full-text Queensland judgments, with enhanced search facility; a database of judicial profiles, including full-text articles and speeches; and access to online Library services and catalogue. One Hundred Years of Queensland Law Reporting

To commemorate 100 years of the Incorporated Council of Law Reporting for the State of Queensland, the Hon BH McPherson CBE will give a free public lecture on Law Reporting in Queensland: Past and Future. The oration will be held on Friday, 9 November at 5:30 pm in the Banco Court, and will be followed by light refreshments. On this occasion we will also be launching a new book on the history of the ICLR by Helen Gregory, entitled Capturing law and history: one hundred years of Queensland law reporting. Back by Popular Demand

Due to popular demand, the Supreme Court Library is printing more copies of the previously sold-out publication, Curious Connections: Master Musicians and the Law by the Hon JB Thomas. This book explores the connection between the seemingly disparate disciplines of music and law and the remarkable people who have been scholars of both, from Telemann and Tchaikovsky to Cole Porter. The author JB Thomas is well-versed in both law and music. Best known as a Judge of the Supreme Court of Queensland from 1982 to 2002, he also studied piano and was awarded an A.Mus.A. in 1951 at age 16.

Centre for Corporate Law and Securities Legislation

The Centre was established by The University of Melbourne in January 1996, its purpose being to undertake and promote research on corporate law and securities regulation. The website contains a searchable database of corporate law judgments from 1999 onwards (and selected judgments from earlier years).

Australian Dictionary of Biography Online

The Australian Dictionary of Biography Online is freely available on the Australian National University website. The website contains some 10,000 scholarly biographies of significant and representative persons in Australian history from 1788 to 1980, including 285 solicitors and 477 barristers.

PANDORA is a continually growing Web archive that aims to collect and provide access to selected online publications and web sites that are about Australia, or are by an Australian author on a subject of social, political, cultural, religious, scientific or economic significance and relevance to Australia. For legal practitioners, and those interested in the law, this site provides access to more than 620 relevant articles and websites on the subject of Law & Criminology.

Queensland Sentencing Information Service

The Queensland Sentencing Information Service (QSIS) is a legal research service produced by the Department of Justice and Attorney-General, in partnership with the Judicial Commission of New South Wales. QSIS is designed to assist legal research in relation to sentences and contains a large collection of linked sentencing related information. Features offered by the service include: case summaries and full text judgments of sentence appeals from the Queensland Court of Appeal; revised Sentencing Remarks from the Supreme and District Courts dating from 1999; and the complete collection of Chief Magistrate Notes from 2000. QSIS is accessible via public PCs at the Supreme Court of Queensland Library in Brisbane, Townsville, Rockhampton and Cairns.

The Reception of English Law Abroad

In April, the Library published The Reception of English Law Abroad by the Hon B H McPherson CBE.

As with the English language, transposing the law overseas produced different accents and usages involving adjustments and change to many of its rules. None of the legal systems of the 100 or more places that now use English law or derivative forms of it is today an exact replica of what it was at the time when it parted from its matrix. Did you know?

The legal database TimeBase is now available at the SCQL.

TimeBase enables access to full-text current legislation and repealed legislation for all nine Australian jurisdictions. It provides Case Link annotations and linking of Acts to their Subordinate Legislation, Bills, EM and second-reading speeches. TimeBase also includes a number of “point in time” research tools that allow designated legislation to be viewed at any nominated date. The SCQL subscribes to “point in time” research for the Corporations Service, the Trade Practices Service and the Commonwealth Criminal Law Service.

You can access TimeBase from PCs in the Brisbane, Townsville, Cairns and Rockhampton libraries.

This book is as comprehensive a statement of the law and practice of applying for special leave as there is. With reference to over 1,800 decisions, and relevant statutory provisions including the new High Court Rules 2004, this work is an invaluable aid to preparing to make or meet an application.

The UK statute law database provides online access to the official revised editions of primary legislation of the United Kingdom. The Statute Law Database also enables the user to: view amended legislation as it has changed over time; see how legislation will be affected by amendments not yet in force; see how legislation has been amended for different jurisdictions; navigate links between affecting and affected legislation and search the text of legislation for words and phrases.

New Electronic Resources

The Library’s subscription to the Austrom database has been expanded to include AGIS plus text, an indexing and full text database that provides online access to the scanned images of journal articles. Source documents include over 130 legal journals from Australian, New Zealand and the Asia-Pacific region indexed in the Commonwealth Attorney-General’s Information Service (AGIS) database. Subject coverage includes all aspects of law including administrative law, banking, companies and securities, constitutional law, copyright law, criminal law, environmental law, family law, human rights, international law, legal aid, and trade practices.

New Electronic Resources

Library patrons can now access the Australian Legal Journals Index through Lawbook Online. This is an indexing and abstracting database of more than 400 journals, including the Australian Law Journal, Criminal Law Journal, Insolvency Law Journal, Australian Journal of Administrative Law, and Tort Law Review, with links to full-text articles in the Lawbook Online collection. New Judicial Appointments

On Tuesday 17 July, a swearing in ceremony was held in the Banco Court for the new District Court judges, His Honour Judge Martin SC and His Honour Judge Searles. The following day the Honourable Justice Daubney was sworn-in as a Judge of the Supreme Court, and the Honourable Justice Muir was sworn-in as a Judge of the Court of Appeal. Five new magistrates were also announced last week. Magistrates Michael Hogan (Southport), Michael Quinn (Sandgate), Damian Carroll (Toowoomba), and Peter Smid (Townsville) were appointed on 20 July. Magistrate Joe Pinder (Cairns) will commence his appointment from 13 August.

BH McPherson Oration on Legal History

The inaugural BH McPherson Oration on Legal History, entitled “Queensland’s only Naval Prize Case”, will be delivered by the Honourable BH McPherson CBE in the Banco Court on Friday 20 July 2007 at 5:30 pm.
